The Enforcement Matrix is designed to help our clients to choose which method of enforcement to choose to enforce their judgment. All you have to do is to match your enforcement method to the assets which you believe your judgment debtor has available. A High Court Enforcement Officer cannot force entry to a private house unless invited so does the judgment debtor have any assets outside the house e.g. a vehicle?

Does the Consumer own the property? Is there any available equity in the property which can be “charged”

Is the Judgment Debtor employed as this will allow a deduction to be made from salary. However it won’t work for a self-employed debtor.

Does the Judgment Debtor have a bank or building society account which has funds? If so, the third party, typically the bank, can be made to pay these over to you as creditor.

Sole Trader Working From Home

A High Court Enforcement Officer cannot force entry to a private house unless invited so does the judgment debtor have any assets outside the house e.g. a vehicle?

Does the Sole Trader own the property? Is there any available equity in the property which can be “charged”

Is the Judgment Debtor employed as this will allow a deduction to be made from salary. However it won’t work for a self-employed debtor.

Does the business have “goods”, office equipment, plant and machinery, or vehicles which are free of finance

Does the Sole Trader own the premises – which could then be subject to a Charging Order?

Unless you can establish an element of employment you won’t be able to use Attachment of Earnings against a Sole Trader.
