Does your debtor own a car?
Whether it be a luxury vehicle or an old beaten up old banger, cars have a real value to their owner. So we find judgment debtors are prepared to pay the amount owing under a Warrant to ensure they don't lose their vehicle.
To assist in locating a vehicle, make, model and registration details are helpful background information which can make locating a vehicle easier, but they are not vital.
If you can't give us that information, it is the job of a Sherforce Enforcement Officer to find any available vehicle and make enquiries about ownership and possible claims such as "tools of trade" and whether the vehicle is "necessary" to the judgment debtor and his/her family.
In both sets of circumstances the onus is on the judgment debtor to make the necessary application to Court for confirmation that any such vehicle is exempt from seizure.
Once Sherforce Enforcement Officers have located the vehicle we check with our online service to see if the vehicle is registered to the judgment debtor. If we find the vehicle matches the name of the judgment debtor, we make a search of the HPI register to see If it is subject to finance, unless Sherforce has the agreement of the finance company - which is generally not forthcoming - Sherforce cannot continue with the removal and sale of the vehicle because it will be claimed by the finance company under their agreement.
